Regulatory Alert from WBA - New Sprinkler Requirement Phases-In

The final “phase in” of the sprinkler rule, which will require sprinklers in
multifamily dwellings with three or more dwelling units, goes into effect after
12.31.10. Builders who want to construct a multifamily dwelling under the current
requirements must make sure that their
project is submitted and received by the DOC before January 1, 2011.
The
administrative rules containing this phase-in were originally adopted by the DOC in 2008. In summary the rule
required:
• As of March 2008, all newly constructed multifamily dwellings with nine units or
more were required to have fire sprinkler systems.
• Beginning January 1, 2011, all newly constructed multifamily dwellings with three
units or more will require fire sprinkler systems.
• For multifamily dwellings that do not contain more than four dwelling units and
are not more than two stories above grade, and that are not served by a community or municipal water
system, less expensive fire sprinkler requirements will apply. In this case, NFPA 13 D fire sprinkler
systems will be required rather than NFPA 13 R fire sprinkler systems. This will make the sprinkler
requirements less expensive in rural areas and other areas not serviced by public water.

The Realtors Association of Northeast Wisconsin is holding
an information meeting on January 13th at Angie’s Café in Shawano from 4:30 – 6:00
p.m. RANW Government Affairs Director Jennifer Sunstrom writes “We need your help and
involvement as Shawano County moves further along with the update of their zoning code. The
zoning code always has had a significant impact on real estate and housing. However, with the
newly-adopted comprehensive plan, the zoning code and revised zoning map will have more impact on real estate and
property rights than ever.”

Dues Deductiblity Notice – 2011
Dues payments
to the Wolf River Builders Association are not deductible as charitable contributions for federal income tax
purposes. However, dues papyments may be deductible as ordinary and necessary business expenses,
subject to an exclusion for lobbying activity. Because a portion of your dues is used for
lobbying by NAHB and WBA, a total of $75.20 is not deductible for income tax purposes.
